Tenant Rights at a Glance

 

Even you don’t have a lease or rental agreement, you are covered by the RTA. If your lease’s date finishes, you will automatically become a monthly tenant. When you are just a newcomer in the world of private market rental, the rent will be set by the landlords. When your tenancy begins, the RTA rules will be run. Before filing a case against your landlord in Small claims court, Be aware of RTA rules around rent.

Landlords can raise the rent only once in a year. If there are any major repairs or renovations done, the landlords will raise the rent. This price was 1.8% of the current rent. And for raising the rent the landlords should notify the tenant at least 90 days beforehand .Here are some RTA rules around rent :

  • You will have your own privacy and landlords can’t enter your unit without a legal reason.
  • You will not be ejected for having a roommate. But if the roommate causes problems for other tenants, damages the property, or makes overcrowding, this may lead to a notice form the landlord and finally evict you and everybody in the unit.
  • You will not be ejected for having a pet but if it is dangerous, making too much noise, damaging the property, or causing any kinds of problems, this will be a real problem.
  • If the responsibility of heating your unit is on the landlord, you will enjoy a 21 degree C minimum from September 15 to May 3.
  • The landlord can’t charge your locks or force you to leave.
  • The only person who can eject you out of the unit, is the Sheriff. The landlord must provide a notice which shows the end of the tenancy with valid reasons. S/he must then apply to the LTB for a legal order to eject you. Then you will be given the right to attend and provide your information.

The responsibilities of the tenants

If you are asked to present information about your income, you should provide credit references as well as your rental history. Nothing gives a landlord the right to refuse anyone because of their race, ancestry, place of origin, color, ethical issues, citizenship, creed, sex, sexual orientation, age, marital status, family status, or being handicap.

When you move in, you should pay the first month’s rent. In some cases, the landlord may request the last month’s rent. If a key deposit is required, it should only cover the replacement cost of the key. You must pay the rent at the time you and the landlord agreed upon.

If the landlord is responsible for the maintenance of the property and you are not satisfied with it, you are not entitled to withhold the rent. This would give the landlord a valid reason for a notice of termination for non- payment of the rent which finally lead to an application with the LTB to eject you.

Keep in mind that you are responsible for cleaning the unit and repair or pay for any kind of damage you caused by the guest or other people living in your unit. If the landlord has a valid reason to enter your property and provides this reason in writing 24 hours beforehand, you should let her/ him enter.

If you change the keys, you should give one to the landlord. In case you want to sublet or assign your unit, you must have your landlord’s agreement. And the last point is, if the landlord needs your unit for his personal use or any of his/her family members, you may have to leave the unit.
